User Agreement

These terms are an agreement between you and Cactus Corn (“Cactus Corn,” “we,” “us”) covering your use of cares.cactuscorn.com, the Cactus Corn Cares fundraising program, and any related pages, dashboards, and emails (the “Service”). By applying for a fundraiser, creating an account, or placing an order, you agree to these terms. If you are accepting on behalf of an organization, you represent that you are authorized to bind it.
Eligibility and accounts
- You must be at least 18 years old to apply for a fundraiser or create an account.
- You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
- You are responsible for all activity under your account, including actions by team members you invite.
- Notify us promptly of any unauthorized use of your account.
Fundraiser applications and campaigns
- Applying does not guarantee approval. We may approve, decline, request more information, or end a fundraiser at our discretion.
- Approved fundraisers run for a defined window, typically seven days, shown on the campaign page.
- Each campaign gets a co-branded page. You may share its link freely but may not misrepresent the program, the products, or the split.
- You are responsible for confirming that running a fundraiser is permitted by your school, district, or organization, and for any permits, taxes, or reporting your group requires.
Earnings and payouts
- Approved fundraisers earn the percentage of qualifying net retail sales stated on their campaign page and program materials, currently 50% of qualifying retail orders attributed to that campaign.
- Qualifying sales exclude taxes, shipping, discounts, wholesale or bulk arrangements, and orders that are later canceled, refunded, or charged back.
- Earnings are calculated after the campaign window closes and a standard return period passes, and are paid to the payout details you provide.
- You are responsible for the accuracy of payout details and for any taxes owed on funds you receive. We may require tax documentation before issuing a payout.
- We may withhold or reverse earnings tied to fraud, abuse, chargebacks, or violations of these terms.
Orders, shipping, and returns
- Product prices, availability, and shipping options are shown at checkout and may change.
- Orders are subject to acceptance; we may cancel and refund an order for pricing errors, stock issues, or suspected fraud.
- Title and risk of loss pass on delivery to the carrier.
- Damaged, defective, or incorrect items should be reported promptly and will be replaced or refunded. Because products are food items, other returns are limited.
Your content
You keep ownership of the logos, photos, descriptions, and other content you upload. You grant Cactus Corn a non-exclusive, worldwide, royalty-free license to host, display, and use that content to operate and promote your fundraiser and the program. You represent that you have the rights to the content you upload, including permission from anyone pictured, and that it is not unlawful, misleading, infringing, or offensive. We may remove content that violates these terms.
Acceptable use
- Do not use the Service for unlawful, fraudulent, or deceptive purposes.
- Do not attempt to access accounts, data, or systems you are not authorized to access.
- Do not interfere with, scrape, overload, or reverse engineer the Service.
- Do not send spam or misuse contact information obtained through the Service.
Our intellectual property
The Cactus Corn and Cactus Corn Cares names, logos, artwork, page templates, and software are owned by Cactus Corn. We grant you a limited, revocable, non-transferable license to use approved brand materials solely to promote your active fundraiser. All other rights are reserved.
Termination
You may stop using the Service at any time and ask us to close your account. We may suspend or terminate access, or end a campaign, if you violate these terms or if we reasonably believe it is necessary to protect the Service or others. Earnings already accrued on qualifying, non-refunded orders will still be paid unless the termination relates to fraud or abuse.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any fundraiser will reach a particular result.
Limitation of liability
To the maximum extent permitted by law, Cactus Corn will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the Service is limited to the greater of the amounts you paid or earned through the Service in the twelve months before the claim, or one hundred U.S. dollars.
Indemnification
You agree to indemnify and hold harmless Cactus Corn and its officers, employees, and agents from claims, damages, and expenses (including reasonable legal fees) arising from your content, your fundraiser, or your violation of these terms or applicable law.
Governing law and disputes
These terms are governed by the laws of the State of Arizona, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to that jurisdiction. Nothing here prevents either party from seeking relief in small claims court.
Changes to these terms
We may update these terms. We will revise the "last updated" date above and, for material changes, provide additional notice. Continued use after changes take effect means you accept the updated terms.
